Art taken without permission

Hello, I’ve recently commissioned an artist for a mane 6 puzzle image (each avatar belongs to a different person).

These were commissioned and paid for by myself. The site (or whoever uploads these images) was never given permission to upload these pictures. I don’t want them on a site where they are exposed to the public (people will think they can steal anything if it’s the image of an official character, but I paid for these and I don’t want anyone using/stealing them), and nor does the artist.
 
Is there a way to get all of these removed? I hope someone can help me with this!

Images can be removed only under artist’s request. You can ask the artist to request take down on those images.

That doesn’t seem right. I paid for these images. I don’t want people stealing them in any way, but I wouldn’t be surprised if they’re all over the internet by now and being used by other people. :c
 
They shouldn’t be distributed to the public without the commissioner’s permission. They wouldn’t do that to original characters, why do it with official characters?
 
I’ll contact the artist and see what they can do about it.

Why would you want to hide such cute art? Are you planning to print this on T-shirts or something?

cute draws, as siberian pizza says, would be a shame if he take down, but if u want to ask him, i think u re in your right… if he accept is other thing :V

Not gonna lie, unless you were going to use them for like a shirt design, then you already got what you paid for. It doesn’t magically become worth less because others can see a digital artwork.

Just because you paid for something doesn’t mean it automatically belongs to you. You didn’t buy any rights to them very likely (unless it was stated otherwise). It’s only up to the artist if they will post them or not - some artist may respect your wish and remove the pictures but some other may post it because they are just entitled to do it. If it’s important to you to keep your commission private, talk it with the artist before commissioning. It’s a deal between you and the artist so make sure to make it clear for both sides or you may be surprised.

They were such cute images! Totally sucks to see them be taken down for fear of art theft, so that the “entire” brony populace can’t see them, because we are literally all being accused of art theft.
 
in most cases, it’s still up to the artist who can see the work that they were paid to draw, unless otherwise stated in the original agreement. I’ve commissioned some artwork myself, of cute ponies, and the first thing I wanted them to do was post them in public xD

Edit: on 2nd thought, this title is wrong, considering that the art was posted public, and then posted here, Derpiboru is “not” a site where people post stolen artwork, it’s our archive site. (though even then, not really real archive in the fact that they do remove artwork, even really old artwork, but still)

That actually raises a very good question about the DNP list: The mods will harp on and on about artist ‘ownership’ of a work, but what happens if said work isn’t owned by the artist. You «insert gender pronoun here» paid for works, hence you can be said to own the work, right? If so, and it’s acknowledge that you retain control over said works, then what happens when a commissioner uploads works that they paid for to this site despite the fact that the artist is on the DNP list?

Legally, copyright - and hence ownership - remains with the artist unless they explicitly transfer that right to the purchaser. Without some form of signed documentation or statement from the artist we have to assume that no such transfer has taken place.

So, unless otherwise stated, it’s still up to the artist whether or not the commissioner can upload images here.
 
(it’s still gets to me that we have active artists on our dnp list that don’t want to upload here for fear of art theft, considering this sites purpose, and how people make sure the correct artists are tagged here, over say DA where people do it)
 
besides, the animations I hope we see one day are fantasyblades commissioned work xD

I know artists have priority to have stuff taken down if uploaded/editted without their consent but what about commissioned art and the ones who had those commissioned?
 
earlier there was a little…‘discussion’ about and edit of this >>1059979 (it’s gone now) and i wondered if a comissioner has any say if the edit is not to their liking. two questions arose:
 
does the commissioner have any leverage in asking the mods to take down edits of stuff they paid to be made because it displeases them?
 
can the creator override the commissioner in letting the edits stay (commissioner does not like edit, creator tolerates/likes the edit, edit stays)?

No. They would have to ask the artist to request the takedown, but it’s up to the artist to decide if they wish for the image to be removed or not. If the artist chooses not to request a takedown of the edit, then it will not be removed.
 
There are occasionally exceptions to that, if an edit violates another site rule (typically Rule #0, Rule #1 or Rule #5). Those are evaluated on a case-by-case basis.
 
Likewise, if an artist is on the DNP list as “Artist Upload Only” or “No Edits”, then edits made without the artist’s verifiable permission will be removed as soon as we are aware of them.

That’s really good to know on that last fact, how artists are telling people that commission them that they want their art to stay up even though others are editing it ^^
 
Still, be great to find a site that doesn’t delete artwork that anyone can upload too xD Be awesome to upload all the dnp artist images that I have somewhere, haha.
 
because being honest, edits will exist no matter what, I mean, your uploading things to the internet, where everyone can see, you’ve technically already lost ownership the second that happens.
