When it comes to child support things are even weirder than that- if you donate to a sperm bank and someone uses that sperm to get pregnant they can sue you for child support and WIN.

technically the reason it’s considered rape is because of the statute, which is an exception written into law when it wouldn’t otherwise be a crime. the reason for making that statute is because won’t someone think of the children, but the reason it’s rape is because the statute exists. if the reason for making the statute had been “because kids have feet instead of ears” it’d still be considered rape.
 
so if you literally rape a child, it’s rape because it’s rape. if you can’t prove they consented, the law applies whether they’re 12 or 40. the statute only comes into play when the kid is claiming they consented. even if they somehow prove that they legally consented, it’s still rape, by statute.

The reason that is considered rape is because a 13 year old doesn’t have the ability to make that sort of decision. Rape isn’t just lack of consent, it’s lack of INFORMED consent. That’s why we don’t let children just do whatever they want. Their brains literally aren’t done yet.

Well, ‘rape by proxy’ is a thing.  
But, apparently, in some cases (Hermesmann v. Seyer to be specific), you could end up paying child support even if there is no third party; A 17-year-old girl had sex with a 13-year-old boy (which is rape by virtue of the 13-year-old not being able to consent), got pregnant, and later managed to argue that the boy should still pay child support.  
Although, an important point during that was that the boy did not object to the acts; It was still rape, but in ‘civil’ terms it was a voluntary act.  
So, I guess, ‘Not if you make it clear that you are not having sex by choice’?

In this case daring saves(seals) the day(deal).
